Comparative Remarks on AI Regulation in the Areas of Product Safety, Data Protection and Mis-/Disinformation from a European Perspective

The lecture will mainly explore the current EU legislative framework and policies for AI, focusing on three key areas: First, we will look at safety provisions as outlined in the AI Act and secondly the protection of personal data under the General Data Protection Regulation (GDPR). AI brings various challenges to these regulatory areas with solutions still being a question of debate among scholars and legislators. The discussion will include a comparative comment of how these topics are addressed in the US framework. Moreover, looking at a final third topic, the lecture will provide an overview of EU regulation and policies surrounding mis- and disinformation which mainly focuses on the requirements for monitoring and removal of illegal content under the recently adopted Digital Services Act. The overview of the obligations of the DSA is followed by a comparison of the approaches taken by the US to address these challenges.
